Law Enforcement Guidelines

These guidelines explain how Shopxare, LLC responds to requests from government and law-enforcement authorities for data about our customers and their End Users. They do not create rights for any person.
1. Our principles
- We require valid legal process. We disclose data only when we receive a request that is valid under applicable law and issued by an authority with jurisdiction over us.
- We review every request and push back on requests that are overly broad, unclear or legally deficient.
- We disclose the minimum data needed to answer the request.
- We notify the affected customer before disclosing their data, unless the law prohibits it, a court order requires otherwise, or there is an emergency. When a gag order ends, we notify the customer.
2. What data we have
Most data in Shopxare is Customer Data controlled by our customers (businesses using Shopxare). Where possible, authorities should request it from the customer directly. We may hold: Workspace and account details; billing records; sign-in records and IP addresses; and the contents of conversations, files and contacts stored by a customer. Calls are not recorded, so we have no call content.
3. Required legal process (United States)
- Subscriber information (such as account name, email and billing details): a valid subpoena.
- Non-content records (such as sign-in logs and IP addresses): a court order under 18 U.S.C. § 2703(d).
- Content (such as message text and files): a search warrant issued under the procedures described in the Federal Rules of Criminal Procedure or equivalent state warrant procedures, upon a showing of probable cause.
4. Requests from outside the United States
Foreign authorities should use a Mutual Legal Assistance Treaty, letters rogatory or another lawful mechanism recognised under US law, such as an agreement under the CLOUD Act. As our data is stored in Türkiye, requests may also be made under Turkish law through the competent Turkish authorities.
5. Emergencies
If there is an emergency involving imminent danger of death or serious physical injury, we may disclose information without legal process, consistent with 18 U.S.C. § 2702. Use the subject line "Emergency disclosure request" and explain the emergency.
6. Preservation
On receiving an official request, we will preserve the identified records for 90 days (renewable once for another 90 days) while formal legal process is obtained.
7. How to send a request
Send requests from an official government email address to [email protected], or by mail to Shopxare, LLC, Legal, 2318 Garden Rd, Shopxare Park, Monterey, CA 93940, United States. Include: the issuing authority, the officer's name, badge or ID number and contact details, the Workspace or account identifiers (such as the Messenger app ID, a website address or an email address), the data requested and the legal basis. We do not accept requests from non-governmental email domains, and we may verify requests independently.
8. Costs
We may seek reimbursement of reasonable costs of responding, where the law allows.
