Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Shopxare, LLC (“Shopxare”, “we”, “us”) for use of shopxare.com and the Shopxare help-desk service.

2. The service

Shopxare provides a shared inbox, live chat, omnichannel messaging, ticketing, reporting and an AI agent named Are. Access is granted after you talk to our team. There is no self-serve account creation on this website.

3. Accounts

You must provide accurate contact details. You are responsible for people you authorise to use a workspace. Notify us if you believe access was misused.

4. Acceptable use

You will not use the service to send unlawful, deceptive or abusive messages, to infringe others’ rights, or to probe or disrupt our systems. See the Acceptable Use Policy.

5. Your content

You retain rights in the messages, files and help content you put in Shopxare. You grant us a licence to host, process and display that content solely to provide the service, including to operate Are on content you designate.

6. Are

Are generates replies from content you supply. You remain responsible for what is sent to customers. Review outputs before enabling unattended sending.

7. Confidentiality

Each party will protect the other’s non-public information with reasonable care and use it only to perform these Terms.

8. Privacy

Personal data is handled under the Privacy Policy and, where applicable, the Data Processing Addendum.

9. Warranties

The service is provided “as is”. We do not warrant uninterrupted or error-free operation. We do not publish uptime percentages on this site.

10. Liability

To the fullest extent permitted by law, Shopxare’s aggregate liability arising out of these Terms is limited to the fees you paid us in the twelve months before the claim, or one hundred US dollars if you paid none. We are not liable for indirect, incidental or consequential damages.

11. Term

These Terms start when you first use the site or a workspace and continue until you or we close the workspace. Sections that by nature should survive (including 7–10, 12) survive.

12. Law

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Courts in Monterey County, California have exclusive jurisdiction, except that we may seek injunctive relief anywhere.

13. Changes

We may update these Terms. Material changes will be posted on this page with a new effective date.
